Maryland Maternity Access Coalition Seeks Statewide Injured Baby Fund

A new coalition comprised of citizens, organizations and health providers say they believe Maryland's "worsening litigation environment" is creating a growing risk that hospitals and doctors could be forced to reduce access to care.

"A similar situation has already occurred over the last decade in Pennsylvania, where Philadelphia-area hospitals closed their birthing centers due to the high costs of medical liability," The Maryland Maternity Access Coalition said.

The coalition planned an event on Monday morning to release results from a recent OpinionWorks poll which it said demonstrates support for the creation of a Maryland Birth Injury Fund.

The coalition said that a statewide "no fault" 'Maryland Birth Injury Fund' funded by hospitals, OB/GYN doctors, and medical liability insurance companies would  help injured children and their families while protecting access to quality maternity health care. 

"If the legislation were enacted, more babies who suffer birth injuries will get the lifetime care they need because acceptance into the program is based on the injury, not the outcome of a lawsuit," the coalition said, adding on its Facebook page that in a court case, the trial lawyer gets to keep up to 40% of the legal award, but an Injured Baby Fund would pay the family directly.
