MD Watching PA Ruling Which Shut Down Breathalyzers

Updated: Friday, August 2 2013, 10:11 PM EDT

The accuracy of breathalyzers being used in the war on drinking and driving is being called into question.

Law enforcement in Maryland insists the results of the test are incredibly reliable, but the state of Pennsylvania has shut down their use in the field completely.

A Dauphin County judge ruled that their accuracy isn't reliable when a person blows a BAC more than 1.5.

The state of Maryland uses just one type of breathalyzer, all of which are inspected monthly by the state toxicologist. The ruling in Pennsylvania could affect hundreds of Maryland DUI convictions.

An appeals court is now reviewing the case in Pennsylvania. Until it issues an opinion, the state will rely on blood tests to determine one’s level of intoxication.
